The problem with Tolkien (and to a degree Conan) is the stories have never been allowed to enter Public Domain. Let the tales be told forever, good and bad. The court continues; the courtiers relate the old and new stories of greatness.
Conan's U.S. copyright expires at the beginning of January 1, 2028. After this date, the original stories and the character of Conan as he appeared in 1932 will become public domain in the U.S., though later works and trademarks will remain protected.

The Hobbit will enter the public domain in the U.S. in 2032, and The Lord of the Rings will enter in 2050, based on the 95-year rule for works published before 1978. But copyright lawyers may stop any fan fiction.
Superman is not entirely in the public domain; however, elements of his original 1938 appearance in Action Comics #1 will enter the public domain in the near future. Specific characters and story elements from later versions, such as the trademarked "S"-shield, later versions of the Kent family, and abilities like flight, will remain protected intellectual property owned by Warner Bros.
